(Associated Press via NewsEdge) A US judge has refused to dismiss a lawsuit seeking to halt Sprint Nextel's plan to create a next-generation wireless network.

Judge Kathleen M. Pantle denied Sprint's motion to dismiss or stay the lawsuit filed in May by affiliate iPCS of Schaumburg, Illinois.

IPCS has claimed Sprint's proposed deal with Clearwire and other partners to create a national high-speed mobile internet service would violate exclusive agreements iPCS has with Sprint.

Sprint is expected to begin the commercial rollout of the network this month.
