The European Court of Justice is set to decide the outcome of an LTE patent battle between Chinese vendors ZTE and Huawei.
A district court in Germany has called on the Court of Justice to consider a number of questions relating to the way EU competition law is applied as part of ruling on a lawsuit brought by Huawei against ZTE in April 2011. The questions relate to a patent covering the ‘method and apparatus of establishing a synchronization signal in a communication system,’ and is one of two patents included in Huawei’s action.
The district court dismissed Huawei’s other claim, which related to LTE base stations and mobile terminals.
